SCUBA.ai Terms of Service & Image License

1. Your account and your photos

By using SCUBA.ai you agree to these Terms. You retain full ownership and copyright of every photograph you upload. SCUBA.ai is provided as a service to you; you do not transfer your photographs to us.

2. The license you grant to SCUBA.ai

By uploading a photograph, you grant SCUBA.ai a perpetual, worldwide, royalty-free, non-exclusive license to:

  1. Process the photograph to identify species and to display the result back to you.
  2. Use the photograph and any associated metadata you provide (such as your reported location, depth, identification corrections, or species labels) to train, fine-tune, evaluate, and improve SCUBA.ai’s machine learning models, including future models we develop.
  3. Aggregate and share anonymized scientific observations derived from your photograph (species, time, generalized location) with research and conservation partners on a non-commercial basis. Sensitive species and operator-flagged sites have location data anonymized to a 1km × 1km grid before any external publication.
  4. Publicly display your photograph within the SCUBA.ai service — including the public gallery and identification pages — and operate that service on an advertising-supported basis. This means we may show advertising alongside, around, or within the service. Any such advertising is sold against the audience and context of the service; it never involves selling, licensing, or placing your photograph itself (see Section 3).

3. What we will NOT do

The license you grant us is bounded. Even as an advertising-supported service, we will not:

  1. Sell, license, sublicense, or otherwise transfer your photographs as image assets — no resale, no stock libraries, no image-licensing arrangements.
  2. Place your photograph inside an advertisement, or use it as advertising or promotional creative (whether ours or a third party’s), or in any product where the image itself is the offering. Showing ads alongside the service (Section 2) is different from putting your photograph in an ad — we do the former, not the latter.
  3. Provide your raw, full-resolution original file to advertisers or other third parties, except as needed to operate the service (for example, sending the image to our model-inference provider for identification).

4. Sensitive locations and species

For protected species (such as IUCN-listed corals, sea turtles, certain shark species) and at the request of operator partners for sensitive sites, we anonymize precise location data to a 1km × 1km grid and bucket timestamps to a one-week window before any external publication or partner sharing.

5. Your rights

You may at any time:

  1. Download your photographs and identification history.
  2. Delete your photographs from SCUBA.ai. Deletion removes the photograph and any future use of it. It does not retroactively remove the photograph from already-trained model snapshots; we will not knowingly include deleted photographs in any future training run.
  3. Withdraw the training license for future uploads, by contacting us. Photographs already uploaded under the prior license remain governed by it.

6. Identification accuracy

Species identifications are produced by AI vision models and are provided as is. We display confidence scores for every identification. Do not rely on SCUBA.ai for safety, dive planning, formal scientific publication, regulatory compliance, or commercial decisions without independent verification by a qualified marine biologist.

7. Eligibility, prohibited content, and termination

You must be 18 or older (or the age of majority in your jurisdiction) to upload photographs. Do not upload: content you do not have the right to upload; photographs containing identifiable human subjects without their consent; content that violates the law or third-party rights. We may suspend or terminate access for misuse.

8. Changes to these Terms

We may revise these Terms. Material changes will be communicated to you and require re-acceptance for continued uploads. Photographs already uploaded remain governed by the version of the Terms in effect at the time of upload.

9. Disclaimer and liability

SCUBA.ai is provided “as is” without warranties of any kind. To the maximum extent permitted by law, SCUBA.ai is not liable for any indirect, incidental, special, or consequential damages arising from your use of the service.
